OVERVIEW

These Terms of Service ("Terms") are a legal agreement between you and Furtrieve, LLC ("Furtrieve" ,"we",  "us" or "our"). They govern your purchase and use of Furtrieve GPS tracking devices (including Furtrieve Pro and Purrtrieve) and any accessories (the "Device"), as well as the mobile apps,websites, cellular and GPS services, and subscription plans that support them (collectively, the "Services").

By creating an account, activating a Device, or using any Services, you agree to these Terms and to our Privacy Policy available at https://furtrieve.com/privacy. If you do not agree, do not use the Devices or Services.Use of the Devices and Services is intended for the United States and its territories. If you use them in another country, you are solely responsible for complying with applicable local laws and restrictions.

ACCOUNT, ACTIVATION & ELIGIBILITY

You must create a Furtrieve account and provide accurate, current information to activate and manage your Devices and Service plans. You are responsible for:

  • Maintaining up-to-date contact and billing details
  • Keeping your login credentials secure
  • All activity that occurs under your account

Furtrieve Devices and Services are intended only for lawful pet tracking and related use. You may not use them to track people or in violation of law.

SUBSCRIPTION PLANS & BILLING

  1. Required Subscription - A valid Furtrieve subscription is required for full functionality of the Devices, including cellular connectivity, GPS location updates, alerts, and history. Without an active plan, functionality may be limited or unavailable.
  2. Plan Types and Pricing- We offer monthly, annual, and multi-year plans. Available options, prices, and included features are displayed at the time of activation and on our website. All plans are prepaid. Taxes and governmental charges may be additional.
  3. Automatic Renewal - All plans automatically renew at the end of each billing period at the then-current price for your plan, unless you cancel before the renewal date. Bystarting a subscription, you authorize Furtrieve to charge your payment methodon file for recurring subscription fees until you cancel.
  4. Free Trials - We may offer free or discounted trial periods for eligible new customers. At the
    end of the trial period, your subscription will automatically convert to a paidplan at the standard rate unless you cancel before the trial ends.

CANCELLATION & REFUNDS

  1. Cancellation by You - You may cancel your subscription at any time through your online account or by contacting our support team. Cancellation is effective at the end of the current prepaid billing period. You will continue to have access to the Services until that date.
  2. 30-Day Money-Back Guarantee (New Subscriptions)- If you are a new subscriber and purchased your first subscription directly from Furtrieve.com, you may request a refund of subscription fees within 30 days of your initial purchase. Shipping costs and certain activation or handling fees are
    non-refundable.
  3. No Prorated Refunds-Except where required by law, we do not provide refunds or credits for partially used billing periods or for renewals that were not cancelled in time. To avoid additional charges, you must cancel before your next renewal date.
  4. Effect on Device Functionality - When your subscription ends, Device functionality may be reduced or disabled,including loss of real-time tracking, alerts, and access to location history.

RETURNS &LIMITED WARRANTY (HARDWARE)

Our hardware (Devices) is subject to:

  • A 30-day return policy from the original date of delivery (excluding shipping),
    and
  • A 90-day limited hardware warranty, as described in the documentation
    provided with your Device or on our website.

Except for this limited warranty, Devices and Services are provided "as is" and "as available" as further described below in the Disclaimer and Limitation of Liability sections.

COVERAGE, PERFORMANCE & LIMITATIONS

Device performance depends on third-party cellular networks, GPS/GNSS satellite systems, and other infrastructure that Furtrieve does not own or control. Coverage and accuracy may be limited or unavailable due to buildings, terrain, foliage, weather, atmospheric conditions, radio interference, network congestion, maintenance, or outages.

We do not guarantee:
• Continuous, uninterrupted, or error-free operation
• Any particular level of GPS or cellular coverage
• Immediate or precise location fixes
• Battery life under all use conditions

NO-LIFE-SAFETY / NO-FAULT ACKNOWLEDGMENT

Furtrieve Devices and Services are tools to assist with pet care and tracking. They are not emergency, life-safety, or critical response systems. You understand and agree that Furtrieve does not guarantee prevention of pet loss, injury, or damage, and is not responsible for:

  • Loss of a pet
  • Injury to a pet or person
  • Property damage
  • Costs such as rewards, travel, professional fees, or veterinary expenses

You assume all risks associated with relying on location information and with any actions you take in attempting to locate or recover a pet.

ACCEPTABLE USE & PROHIBITED CONDUCT

You agree to use the Devices and Services only:

  • For lawful pet tracking and related purposes, and
  • In accordance with these Terms and applicable law.

You may not:

  • Use Devices to track or monitor any person
  • Tamper with or modify SIM cards, firmware, or network connections
  • Reverse engineer, scrape, or improperly access our systems or data
  • Use the Services in a way that overloads or interferes with our networks
  • Use Devices as a 911 or emergency calling device

We may suspend or terminate Service for misuse or violation of these Terms.

SOFTWARE LICENSE & UPDATES

Device firmware, mobile apps, and related software are licensed, not sold. We grant you a limited, non‑exclusive, non‑transferable license to use the software solely in connection with your Furtrieve Devices and for your personal use, subject to these Terms.

We may provide automatic updates, patches, or changes to maintain or improve the Services. Some updates may be required for continued use.

PRIVACY & DATA

We collect and process data as necessary to provide and improve the Services, including account details, Device identifiers, location data, and diagnostics. Our handling of personal information is described in our Privacy Policy at https://furtrieve.com/privacy, which is incorporated into these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

INDEMNITY

To the fullest extent permitted by law, you agree to indemnify and hold harmless Furtrieve and its affiliates, officers, employees, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Devices or Services
  • Your breach of these Terms
  • Your violation of any law or third-party right

SERVICE CHANGES, SUSPENSION & TERMINATION

We may modify features, plans, compatible networks, or software to comply with law, maintain or improve the Services, or for business reasons. If we make a material change to pricing or Terms, we will provide at least 30 days’ notice before your next billing cycle. Continued use after the effective date constitutes acceptance.

We may suspend or terminate your Service, with or without notice, if we believe:

  • You are not paying required fees
  • You are engaging in fraud, abuse, or misuse
  • You are violating the law or these Terms

Upon termination, you must stop using the Services and, if applicable, power off Devices to prevent further data transmissions.

DISCLAIMER OF WARRANTIES

Except as expressly provided in any limited hardware warranty, the devices and services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, or non‑infringement. We do not guarantee that the devices or services Will be uninterrupted, error‑free, or free of harmful components.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, furtrieve and its affiliates and service providers Will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of pet, lost profits, lost data, business interruption, or reputational harm, even if advised of the possibility of such damages.
In all cases, furtrieve’s total aggregate liability for all claims arising out of or relating to the devices or services Will not exceed the amounts you paid to furtrieve for the services during the twelve (12) Months immediately preceding the event giving rise to the claim.

EXPORT COMPLIANCE

You agree to comply with all applicable U.S. export and sanctions laws and regulations. Devices and software may not be used, exported, or transferred in violation of such laws.

GOVERNING LAW, ARBITRATION & VENUE

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of laws rules.
Most disputes will be resolved through binding arbitration, on an individual basis, and not as part of any class or representative action, under an arbitration provision that may be set out in more detail in our legal notices. Where a claim is permitted to proceed in court (for example, in small claims court), the exclusive venue will be the state or federal courts located in Hamilton County, Indiana, and both parties waive any objection to such venue.
